In order to ensure that you feel secure when visiting our website, we comply strictly with statutory provisions when processing your personal data, and we would like to inform you in detail here about how we collect and use data.

This Data Protection Policy applies only to LAND-LEBEN and its website www.land-leben.com.

Use of the website by minors

We collect, use, and disclose personal data only where this is permitted by law or you have consented to data collection. We collect information from you directly from the data you enter and automatically through the technologies of online applications.

We collect, store, and process your data for the entire settlement of your purchase and for technical administration, statistical analyses, our own marketing purposes, and to prevent crimes and fraud and ascertain security threats. In addition, we use your data in particular to perform the following actions:

  • in order to provide and improve our service and support;
  • in order to contact you at your request;
  • for data analyses;
  • for internal audits;
  • for developing new products;
  • for ascertaining trends in use;
  • in order to prevent or ascertain security threats, fraud, and other malicious activities;
  • in order to meet our statutory requirements and to enforce our agreements;
  • for the purpose of billing and statistics about access behaviour (e.g. number of times a source is accessed, total number of times accessed by the customer and per source, changes in access frequency).

2.2.1. Log files

When you visit our website www.land-leben.com, log files are stored by default for technical reasons. These files contain the following data: date, time of day, name of the accessed page, IP address, the website from which you came to visit us (referrer URL), type of browser, and operating system. In addition, we automatically collect and store which pages you visit. These data are stored and analysed in anonymised form. Anonymised means that we cannot attribute the data to an identified or identifiable natural person or can do so only with a disproportionately large expenditure of time, costs, and labour.

2.2.2. Disclosure to third parties

Your personal data are disclosed to third parties only if this is permitted by law (in order to enforce or satisfy an official order, a statute, or a compulsory measure, to identify and prevent security threats, fraud, or other malicious activities, to protect or enforce our rights and property, or to protect the rights or personal safety of our employees or third parties), for marketing purposes, or if you previously provided consent.

It may be the case that our website includes third-party content, such as material from Google Maps, YouTube videos, RSS feeds, or images from other websites. This always presupposes that the providers of such content detect the IP addresses of users, since without the IP address, they cannot send the content to the browser of the respective user. Thus, the IP address is necessary for displaying such content. We make an effort to utilise only content for which the relevant provider uses the IP address merely to deliver the content. However, we have no control over whether the third-party provider stores your IP address, e.g. for statistical purposes. Once we are aware of this, we will inform you about it.

In some cases, your personal data are stored in the U.S. by third parties, such as Google, Facebook, etc., and disclosed by them for certain purposes. In order to learn about the purposes for which your data are disclosed, we recommend that you read the respective data protection policies.

2.3. Use of your data for advertising purposes

We use your data also for the following purposes: in order to provide information about specific products or marketing campaigns, in order to recommend products or services that might interest you, in order to invite you to take part in surveys or similar promotional activities.

2.3.1. Subscribing to the newsletter

The data provided when subscribing (title, name, address, email address) are used only for sending the LAND-LEBEN newsletter.

For the purposes of sending the newsletter, we use the email address that you provided and then require your confirmation that you, as the owner of the email address, are in agreement with receipt (known as “double opt-in”). You may cancel the subscription at any time by clicking the unsubscribe link provided in the newsletter or by sending an email to office@land-leben.com.

2.3.2. Product recommendations

Moreover, we use your data in connection with marketing campaigns in order to notify you – irrespective of whether you have subscribed to a newsletter – about specific products and services that might interest you. These marketing campaigns take the form of mailings by email or regular mail. Consent to the receipt of such mailings is voluntary and may be revoked at any time. The only data that are collected and processed are those that are essential for the indicated purposes. Only anonymised data are processed, provided that this is possible for achieving the purpose and the effort is reasonable.

Personal data are erased once the purpose for which they were originally collected no longer applies and this is not prevented by statutory retention periods. If in a given case there are legitimate interests in such data, they will continue to be retained until the legitimate interest has been legally clarified.

5. Obligation to maintain data secrecy

All employees of LAND-LEBEN and group companies are contractually obligated to maintain confidentiality and are regularly instructed and trained about the secure treatment of personal data and other critical data.

6. Data security

Protecting the confidentiality, availability, and integrity of data is an essential task of LAND-LEBEN. This applies equally to business secrets, customer data, personal data, and other critical information.

For this purpose, we establish and continuously improve technical and organisational security measures in accordance with the state of the art, as well as internationally recognised best practices and security standards.

7. Data protection officer

LAND-LEBEN is not required to designate a data protection officer, because Article 37(1) of the EU General Data Protection Regulation does not apply.

But in the spirit of data protection, LAND-LEBEN has decided to designate a data protection coordinator. This individual is available to data subjects and the data protection authority as a point of contact and handles data protection issues in the corporate group.

8. Rights of data subjects

Every data subject whose personal data is processed by LAND-LEBEN may at any time invoke the individual rights of data subjects and assert them against LAND-LEBEN. In order to exercise your rights as data subject, you may at any time send an email to datenschutz@land-leben.com.

8.1. Right to information

Data subjects may at any time request information about the personal data concerning them that are being processed and about the purposes of such processing.

8.2. Right to rectification

Data subjects have the right to request the prompt rectification of incorrect personal data concerning them.

8.3. Right to restriction of processing

Data subjects have the right to restriction of processing if the accuracy of the data concerning them is contested, the processing is unlawful, the data are no longer needed for processing, or the data subjects have objected to processing.

8.4. Right to object

Data subjects have the right to object at any time to the processing of personal data concerning them.

8.5. Right to data portability

Data subjects have the right to receive the personal data concerning them, which they have provided to LAND-LEBEN, in a structured, commonly used and machine-readable format. In addition, they have the right to request the transmission of those data to another controller, to the extent technically feasible. Portability applies only to personal data that are processed by automated means.

8.6. Right to erasure – Right to be forgotten

Data subjects have the right to request that personal data concerning them be erased without undue delay if the legal basis for the processing of data is lacking or no longer applies, data processing has been objected to, data processing is unlawful, and no statutory retention period make erasure possible.

With respect to the rights of data subjects, data security is of great importance, for which reason the assertion of data subject rights is possible only after the identity of the data subject has been unequivocally established.

8.7. Right to lodge a complaint

If you believe that the processing of your data is in violation of data protection law and that we have infringed your rights, we ask that you contact us so that we can resolve any questions. You of course may at any time lodge a complaint with the data protection authority.

9. Amendments to this Data Protection Policy

If we amend this Data Protection Policy, we will publish the amended version here with an updated version date.

This Data Protection Policy was most recently updated on 15 May 2018. The date on which this Policy enters into effect for a specific website depends on the date on which the website first received a link to this updated Policy.

10. Data transmission

Personal data are transmitted to recipients outside of the corporate group and to recipients in countries outside of the EU only in conformity with applicable laws and on a lawful basis, as well as in observance of utmost confidentiality and data security.

In connection with processing, personal data are exchanged between companies of the LAND-LEBEN Group. This exchange is governed by a set of rules, which constitutes a uniform standard for the protection of data and their processing in conformity with the law.

In connection with processing, LAND-LEBEN makes use of various processors. All processors are obligated under a processor agreement to comply with the applicable provisions of data protection law.

By using the services, you expressly declare that you consent to the transmission of your data to countries outside of your country of residence, which may have data protection provisions that differ from those in your country.

The continual improvement of quality and processes is of utmost importance to LAND-LEBEN.
